Action by plaintiff Louis Menako against defendants Frank Kassien and Ella Kassien, his wife, for recovery of $3,000 paid on a contract to purchase a farm from defendants. Plaintiff moved for summary judgment, which motion was granted; and from a judgment against defendants for the sum of $3,000 plus interest and costs, defendants appeal. On July 7, 1951 plaintiff made a written offer to purchase defendants' farm in Waushara county for $15,800 and tendered $1,000 as earnest money; defendants accepted such offer. On August 1, 1951 a supplemental agreement was entered into between the parties whereby plaintiff made an additional earnest money payment of $2,000 and took over the management of the farm, subject to the written approval of Frank Kassien to sell any stock, machinery or crops, 'until the full purchase price of $15,800 is paid just as soon as Louis Menako sells his home in Chicago.' On October 4, 1951 plaintiff's attorney wrote a letter to defendants' real estate broker requesting 'some sort of adjustment as to representations' made by defendants regarding the farm, machinery and animals, and suggesting a personal Discussion of the matter in the near future.
